Acss to a � <br /> .:e00//D 54 / <br /> 1.1, Access Right, Subject to the restrictions set forth in Paragraph 1.2 of this Right of finny <br /> Agreement, Liceasar hereby consents to entry upon that certain real property referred to herein as the <br /> Lawrence Property, APN 191-260-14, 191-730-01 and 191-230.02 specifically depicted on tba <br /> attached Exhibit "A" (the "Property"), by Licensee and its employees, consultants and contractors, <br /> after the date of this Agreement and until any termination of this Agreement in order to conduct, at <br /> Licensee's sole cost and expense, such inquiries, inspections, investigations, placement of monitoring <br /> wells, engineering, surveying, soils, geological, archeological, hydrological, environmental and/or <br /> biological investigations and assessments, and other tests and studies as Licensee deems appropriate in <br /> connection with Licensee's use of monitoring wells for Licensee's Monitoring and use of monitoring <br /> well data. <br /> 1.2. Restrictions. Llcensee shall strictly comply with the following in connection with any <br /> activities by Licensee described in Paragraph Ll; <br /> A. Licensee's access onto the Property shall be unlimited. and non-exclasivc, <br /> however, it shall be revocable per Paragraph E. <br /> B. Licensee shall give Licensor and Licensor's Lessee ('farmer"), George Perry <br /> and Sons, at least one (1) full business days' (meaning at least twenty-four (24) hours) prior verbal or <br /> written notice of any entry by, or on behalf of, Licensee and/or Licensee's Representatives onto any of <br /> the Property, which notice shall include the general time and place of the entry and the placement of <br /> the drill sites and monitoring wells, tests or investigations or activities which Licensee and/or <br /> Licensee's Representatives desires to perform an the Property. <br /> a) Furtharmar , Licensee agrees to discuss the placement of the monitoring <br /> wells with the Licensor's (farmer) once this agreement is signed by 4 parties, <br /> and per Paragraph C Licensee shall interfere only as reasonably necessary with <br /> the far=r's ability to farm the property. <br /> C. T iceasce shall not cause or permit any unreasonable interference with Licensor's <br /> activities an the Property or on any nearby real property; <br /> D. Licensee shall peep the Property free and clear of any and all liens and <br /> encumbrances resulting from aay activities by, or on behalf of, Licensee and/or Licensee's <br /> Representatives; <br /> E_ This Right of Entry Agreement shall end upon the termination of the option, or <br /> if extensions to the Option are made, at the end of tbtse extensions, or upon the outright purchase of <br /> 1A,nemee F4apem R&of Entry 1DI1 M4 7 <br />
