NO IMPACT TO WATER WAY. <br /> OBSERVATIONS: <br /> Met with Jordan Cain of Pacific Ethanol and Steven Bender of the Port of Stockton.Witnessed corn oil staining and debris of <br /> wet cake on asphalt at the spill location. No soil,waterways, or storm drains were impacted. Pacific Ethanol to complete <br /> clean up of asphalt tomorrow 10/24/17. Steven Bender of the Port of Stockton suggested to Pacific Ethanol to use a street <br /> sweeper to complete the clean-up, at which point he would be satisfied with the clean up. <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br /> (a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br /> procedure[HSC 25160(b)(3)]. Provide a wastethazardous waste disposal records to the EHD for all clean up debris <br /> associated with this spill clean up. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> • Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> • Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit within 30 days of the spill date. <br /> ° Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGEISPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
