State of California DATE OF ORIGINAL INCIDENT INCIDENT 0 OR ID COUNTY ['A(;E <br /> Department of Pesticide Regulation <br /> Pcs icide Enforcement Mo.04 DAY 18 YR. 2006 INV 13-24 Sart Joaquin 2 <br /> PESTICIDE EPISODE LOCATTONISUSJECT <br /> INVESTIGATIVE REPORT <br /> NARRATIVE CONTINUATION San Joaquin County Mosquito Abatement District White Slough Facility <br /> ❑ SUPPL.E IE-NPAL.REPORT <br /> ❑ OTHER: <br /> On September 4,2013 at 9:37 am San.Joaquin County Agricultural Commissioner Scott Hudson, received an <br /> e-mail from Roberta Jetter Environmental Scientist with the Department of Pesticide Regulations Enforcement <br /> Branch. In the e-mail she asks our office to investigate complaint number It 992 that is attached to the e-mail. <br /> Complaint No. 11992 is on a Cal/EPA Environmental Complaint form and was submitted September 3,2013 at <br /> 3:14 p.m. from a Ms. Tiffany Anderson. Ms. Anderson's complaint is about the San Joaquin County Mosquito <br /> Abatement District(SJCMAD)mainly at their White Slough site. SJCMAD provides surveillance and control <br /> services to enhance public death by managing mosquito populations as well as a variety of vector control <br /> programs. She states concerns that there was failure to provide for the appropriate safety of their employees, <br /> disclose the exposure to certain chemicals to their employees,ensure the district educates and trains employees <br /> on the chemicals used, and ensure the district reports all chemical treatments to the appropriate governmental <br /> agencies. She listed Formalin as a material that she had specific concerns with. Ms. Anderson also lists <br /> additional complaints in the e-mail that the Agricultural Commissioner's Office does not have the authority to <br /> investigate those matters for example testing the surrounding bodies of water for chemicals,pathogens,parasites, <br /> and human viruses. <br /> On September 11,2013 I(Agricultural Biologist Kimberly D. Martin)received the complaint and contacted <br /> Mr. Eddie Lucchesi manager of SJCMAD. I asked if he was aware of the complaint by Ms. Anderson. He said <br /> he was and had already been contacted by Mr. Gary Stoekel, Assistant Agricultural Commissioner for San <br /> Joaquin County. He told me that he had sent documents over to our office that included the label for Parasite-S <br /> the product containing Formalin,detailed information on the application procedures for the product and the San <br /> Joaquin County Grand Jury findings from Case number 0311. According to Mr. Lucchesi we were not the first <br /> agency to inspect SJA.M.AD because of a complaint from Ms. Anderson. They had also been inspected by the <br /> Division of Occupational Safety and Health(DOSH) and the afore mentioned Grand Jury investigation. Among <br /> the previously mentioned documents there was a copy of the inspection treatment record for Parasite-S. I <br /> discussed with Mr. Lucchesi that I needed to schedule a Headquarters inspection for the facility at White Slough <br /> and the Stockton Facility to go over the pesticide training records since there was a general complaint that there <br /> was failure to provide for the appropriate safety of their employees, disclose the exposure to certain chemicals to <br /> their employees,ensure the district educates and trains employees on the chemicals used, and ensure the district <br /> reports all chemical treatments to the appropriate governmental agencies. We set dates and times for the <br /> following,week to complete the headquarters inspections. <br /> Inspection of the Parasite-S Label showed that it does not have an EPA Registration number and any safety <br /> regulations that pertain to the material are regulated by DOSH. The label indicates that Parasite-S is used for the <br /> treatment of parasites, external protozoa and fungi on fish and fish eggs (See Label Attached). From a memo <br /> dated September 5,2013 (See Attached)the last time Parasite-S was used was March 12, 2009,supported by an <br /> inspection treatment record(See Attached). There was also a label for Parasite—S (See Attached). <br /> On September 18, 2013 at 9:15 am I met with John Fritz assistant manager for SJCMAD at the White Slough <br /> site. We began our inspection by touring the outside of the facility looking at the fish ponds where applications <br /> of Parasite-S and other materials. There are two types of ponds on the site, the first kind are large above ground <br /> black plastic ponds. I was told they were for the younger fish and would also be used as quarantine tanks if there <br /> are any sick or wild fish at the site. These smaller tanks are to the north of the office at this site.
