The soil ditches on both <br /> sides of the road were impacted. Patriot Environmental scheduled to clean up the spill. <br /> OBSERVATIONS: Patriot Environmental cleaned up the spill on the road using absorbent and placed the contaminated absorbent into <br /> the road side ditches where the soil is also contaminated. The soil on both sides of the road was impacted.Visqueen was used to <br /> cover the contaminated soil and absorbent in the ditches until the soil is excavated. Patriot Environmental is scheduled to begin the <br /> excavation on Friday, July 7,2017 at 7:00 AM.Verification of clean up in both ditches along the road is pending. Soil analytical results <br /> and disposal records are to be provided to the EHD. <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is prohibited <br /> when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5(a)]. Please be <br /> aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting procedure[HSC 25160(b)(3)]. <br /> Provide a waste/hazardous waste disposal records to the EHD for all clean up debris associated with this spill clean up. <br /> VIOLATIONS: <br /> ® Discharge of any Waste, including Sewage <br /> (CA Health and Safety Code 54 11) <br /> ❑ Discharge of Waste or Sewage to Water or within 150' of Waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ® Improper Disposal of a Hazardous Waste <br /> (CA Health and Safety Code 25189.5) <br /> ® Permitting or Maintaining a Nuisance <br /> (S✓C Ordinance Code Section 8-5100) <br /> ❑ Other: <br /> CORRECTIVE ACTIONS/ORDER: <br /> Immediately contain, clean up, and dispose of the waste at an authorized, permitted location. <br /> Ensure that clean up personnel possess adequate training. <br /> IN Investigate and abate contamination under the oversight of the appropriate lead agency. <br /> IN Submit copies of hazardous waste manifests/disposal records to the EHD within 30 days. <br /> 3 Other: Analytical results Correct By: IMMEDIATELY <br /> COST RECOVERY:All EHD Staff Time Associated with this Spill Response is Billed to the Responsible Party at <br /> the Current Hourly Rate.
