r • <br /> Momm�in F(wse Clevelopmem R`b <br /> SITE ACCESS AGREEMENT <br /> THIS SITE ACCESS AGREEMENT (`Agreement") is entered into by and between <br /> CHEVRON U.S.A. INC. ("Ckevron'�, a Pennsylvania corporation, and LINDA MARTIN <br /> ("Owne)"). <br /> RECITALS <br /> A. Owner holds record title to certain real property located at Assessor's Parcel <br /> Number 209-150-028, 20199 Wicklund Road, in the City of Tracy, County of San Joaquin, State <br /> of California(the"Property"); <br /> B. Standard Oil Company of California, a predecessor to Chevron,operated a crude <br /> oil pipeline on property adjacent to the Property; <br /> C. Chevron seeks Owner's authorization to access the Property to conduct the Work, as <br /> defined in Paragraph 1 (Rights Granted) below;and <br /> D. Owner is willing to grant Chevron access to the Property for the above-described <br /> purposes. <br /> TERMS AND CONDITIONS <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises herein, <br /> the parties hereby agree as follows: <br /> 1. RIGHTS GRANTED <br /> Owner hereby grants to Chevron, its employees, agents, representatives, <br /> consultants and contractors, a license over, under and across the Property for the purpose of <br /> performing environmental assessment activities (the "Work'). Said Work may include, but not <br /> be limited to, soil, vapor and groundwater sampling. Prior to the installation of any new <br /> equipment on the Property, Chevron and Owner shall work together to determine the appropriate <br /> location for the new equipment. Owner agrees to cooperate with Chevron, including the execution <br /> of additional documents, if necessary, in order to obtain permits or other documents from a <br /> government agency required to install, abandon or remove Chevron's equipment. <br /> 2. PEFORMANCE OF THE WORK <br /> Chevron agrees, at its sole cost and expense, to conduct and perform the Work in a <br /> prompt, safe, efficient and workmanlike manner and in compliance with all applicable federal, <br /> state or local laws, regulations or ordinances. <br /> 3.
