When the <br /> Work Plan was not submitted on 30 December 2009, Brian Taylor of my staff left a <br /> voicemail message for Mr. Jeffery Cosgray on 13 January 2010 and also contacted <br /> Mr. Cosgray by email on 20 January 2010. Mr. Cosgray confirmed by email that that <br /> you are Chevron's contact for this Site. Mr. Taylor spoke to you by telephone on <br /> 21 January 2010. <br /> During the telephone call, you informed Mr. Taylor that Chevron had not provided a <br /> response to our Work Plan Request because Chevron had been unable to establish <br /> contact with Kinder Morgan Energy Partners L.P. (KMEP) and collaboratively prepare <br /> the work plan as requested in the Work Plan Request. Mr. Taylor informed you that <br /> KMEP responded to the Work Plan by (1) conducting a site inspection, (2) attending a <br /> meeting at our office to discuss the findings of the inspection, and (3) submitting a <br /> report of the inspection. As agreed during the call, attached is a copy of KMEP's <br /> inspection report. <br /> On 25 January 2010, we received Chevron's letter referencing the telephone <br /> conversation and requesting an extension to 28 February to submit the work plan. <br /> Chevron has failed to respond to the Central Valley Water Board's request for an <br /> investigation work plan by the due date of 30 December 2009, and the work plan is now <br /> past due. <br /> California Water Code Section 13207 authorizes the Central Valley Water Board to <br /> compel the submission of technical reports. We concur with your request for an <br /> extension. However, Chevron's suggested due date of 28 February 2010 falls on a <br /> Sunday, so the investigation work plan is now due by 26 February 2010.
