M. Scott Mansholt - 2 - . 6 August 2009
No Further Action Required Deterrfttion
Mountain House Development Site
Central Valley Water Board staff received the site specific Soil Management Plan (SMP),
dated 25 November 2008 that provides guidance for interested parties who may conduct
excavation and/or maintenance activities at the Site in the future. The SMP, which designates
Chevron as the responsible party for any issues that arise related to the crude oil leaks, was
submitted to the interested parties identified at the Site.
On 10 June 2009, Central Valley Water Board staff notified interested persons of their
opportunity to provide comments to Chevron's 18 March 2009 request for NFAR
determination. Property owner(s) determined to have been affected by crude oil leaks from
the historical pipelines located on or near the referenced site were notified by certified mail.
No responses were received during the 30-day comment period.
The reports concluded that site assessments, characterization, and risk assessment have
provided the appropriate technical data and rationale to support a NFAR determination.
If existing, additional, or previously unidentified chemical constituents at Mountain House
Development Site #5 cause or threaten to cause pollution or nuisance or are found to pose a
threat to public health or water quality, then: 1) nothing in this determination is intended or
shall be construed to limit or preclude the Central Valley Water Board or any other agency
from taking further enforcement action and 2) this letter does not relieve Chevron of any
responsibilities mandated under the California Health and Safety Code and the California
Water Code. Nothing in this determination shall constitute or be construed as a satisfaction or
release from liability for any conditions or claims arising as a result of past, current, or future
operations at Mountain House Development Site #5.
If you have any comments or questions, please contact Dean Hubbard at (559) 445-5179.
Pamela C.
