e• <br /> RIGHT OF ENTRY <br /> This RIGHT OF ENTRY is made and entered into between Michael D. Olivarez. Trust <br /> (GRANTOR) and the CITY OF STOCKTON, a Municipal Corporation in the County of <br /> San Joaquin, State of California, (CITY]. <br /> The undersigned GRANTOR hereby grants to the CITY, its agents, employees, and <br /> contractors, permission to enter upon the property described as 300 South California <br /> Street, Stockton (San Joaquin County Assessor's Parcel Number 149-095-01) for the <br /> purpose of Phase I and Phase II Environmental Assessment work and where necessary <br /> the collection and testing of soil and g oundwater samples and all incidents necessary <br /> to accomplish said work on, in, under, or above the subject property. A copy of the <br /> assessor's parcel map of the subject property is attached as Exhibit "A". <br /> It is understood that the City of Stockton shall indemnify and hold Grantor harmless <br /> from any liability resulting from the use and occupancy of said property under this right <br /> of entry. It is further understood that the City of Stockton shall return the property to its <br /> original or better condition immediately upon completion of work. The City will be <br /> responsible for properly handling all sample materials requiring disposal. Results of <br /> tests will be made available to the Grantor, if desired. <br /> The right of the City of Stockton to Enter and occupy said property shall commence <br /> upon execution of this document ands all terminate upon completion of said work. <br /> DATED GRANTOR <br /> MICHAEL D.
