For the purpose of conducting the above-describe <br /> 4 activities, the Petitioner, and its agent, shall have entry Ont <br /> 5 the Property, without interference, to the following areas : (1) <br /> 6 the exterior of the structure (s) , (2) the interior of th <br /> ' 7 structure (s) , (3) parking facilities and other open areas, an <br /> ' 8 (4) any other area or structure that is observed by Petitioner a <br /> 9 the time of the inspections and would be necessary for completin <br /> ' 10 the environmental determinations for the Property. <br /> 11 5 . The entry and activities described above shall no <br /> 12 result in actual damage and/or substantial interference wit <br /> ' 13 possession and use of the Property. If soil sampling occurs, <br /> 14 boring locations will be restored to the original condition. An <br /> ' 15 penetration through concrete or asphalt will be reconditioned. <br /> 16 6. Petitioner, and its agent, shall not discuss the <br /> 1 17 purpose of the inspection with any person who is identified as a <br /> 18 tenant of Respondent . Petitioner, and its agent, shall refer an <br /> 19 designated tenant or tenants who make inquiries as to the purpose <br /> 20 of the activities of Petitioner, and its agent, to owner , <br /> 21 7 . Respondent shall provide access to each of the areas <br /> ' 22 described above L - i5 — , 2000, at to ;o d <br /> ' 23 a .m. / until such time as the Phase I is completed. <br /> 24 B . Should Petitioner determine that a Phase II is <br /> 25 required, Petitioner shall notify owner of the need for such <br /> 26 Phase II . Petitioner and owner shall agree to a time and date <br /> 27 convenient to conduct the Phase II .
