As previously discussed with you, if the contamination found is not from an underground <br /> storage tank, the EHD does not have regulatory authority over the investigation and remediation of the site. There is a <br /> section in the Health and Safety Code (Section 101480-101490) that would allow EHD to enter into a remedial action <br /> agreement with your agency, but it is voluntary on both agency's part. Your other options are to contact the California <br /> State Department of Toxic Substance Control or the California Regional Water Quality Control Board, Central Valley <br /> Region for oversight if you need a "No Further Action Required" determination by their regulatory authority. <br /> Kleinfelder stated in the April 27, 2005, Status Summary that"additional excavation and off-haul"was not cost effective <br /> and that your agency's intends to conduct additional assessment of the lateral and vertical extent of the TRPH impacted <br /> soil and collect a grab groundwater sample to assess impact to groundwater. EHD agrees that this action is appropriate <br /> given the contaminants of concern and your desire to continue with the construction at the site. <br /> Margaret <br /> i <br />
