SAN1 O A Q U I N Environmental Health Department <br /> COU N '1 Y <br /> Complaint Record Daily Time and Activity Summary from 1/1/2010 to <br /> 2/5/2019 for COJXJ6610 located at <br /> BYRON RD & WICKLUND RD TRACY, CA <br /> Activity Date Recorded by <br /> 01/11/2019 Received complaint from Kimberly Blackwell at 11AM. Called CHP Srgt Rickman, PE 2546 FLORIDO <br /> 270 min who verified the release of 30-40 gallons of BlueDEF Diesel Exhaust Fluid onto SC 544 <br /> the roadway and soil from a tanker truck. Rickman stated the release has been <br /> stopped and it did not appear the fluid impacted the tracks. Rickman sent me the <br /> Safety Data Sheet(SDS) for the fluid, which states —67% of the material is water <br /> and —33% is urea. Informed Rickman that the responsible party will have to get the <br /> release cleaned up. Obtained the responsible party information from Rickman. <br /> Discussed diesel exhaust fluid with John Alaniz, REHS, and Haza Saeed, RENS, <br /> before leaving for the site. <br /> Arrived on site at—12PM. Met with Sgt. Rickman of CHP and David Giddings of <br /> AG2 Transportation Services, LLC and driver of the tanker truck. Observed white <br /> staining from the evaporated fluid on westbound Byron Rd. Observed dirt that <br /> appeared freshly saturated from the fluid release, adjacent the tanker truck. The <br /> tracks did not appear to be impacted by the fluid. According to David Giddings, the <br /> release came from an outlet on the underside of the truck, which he tightened to <br /> stop the release. The release was stopped prior to my arrival, and no waterways <br /> were impacted. Ponder Environmental has been contracted to conduct the <br /> clean-up. Issued Mike Cunningham, owner of AG2 Transportation Services, LLC <br /> the Notice To Abate (NTA). David Giddings signed the NTA on behalf of AG2 <br /> Transportation. Attempted to email the NTA to ag2dispatch@outlook.com, but was <br /> unable to due to receiving an error message when logging in to my email. <br /> Informed Srgt Rickman that the Cal OES spill report needs to be updated to reflect <br /> that SJC EHD is not performing the clean-up, but rather a clean-up contractor. <br /> Srgt Rickman stated he would get the report updated. <br /> Rickman and Giddings left the site, at approximately 1 pm and 1:30pm, <br /> respectively. I remained on site and entered the data into Envision Connect <br /> Remote (ECR) for the Emergency Response Record Form and the Notification of <br /> Hazardous Waste Discharge (Prop 65). Downloaded photos of the spill, prior to <br /> clean-up. Completed narrative. <br /> At 2:20pm, Ponder Environmental arrived onsite. Provided Chris Johns of Ponder <br /> with Paul Holt's, Union Pacific Rail Road Haz Mat Specialist, phone number, to <br /> verify that Ponder may conduct the clean-up, since the spill occurred about 50ft <br /> from Union Pacific rail road tracks. Chris verified with Paul that he may conduct <br /> the clean-up of the spill. Chris stated he will be taking samples of the soil for the <br /> waste determination. Notified Chris, that EHD will need a copy of the sample <br /> analytical, prior to disposal, and he will need to call the EHD ER cellphone when <br /> he is close to being done with clean-up so that our ER on-call inspector can come <br /> out to verify the clean-up. Chris agreed. Left site. <br /> Arrived at EHD at 3:30pm. <br /> Called and spoke to Famy Uvalle and Mike Cunningham of AG2 Transport. <br /> Notified them that the sample lab results and final waste disposal records will be <br /> needed to close out the complaint. Notified Mike that EHD's current rate is <br /> $152/hour. <br /> Received a call from Chris of Ponder Environmental stating they are done with the <br /> clean-up. <br /> Updated Leyna Huynh, REHS, on the clean-up and let her know that Ponder <br /> Page 2 of 3 <br />
