UST LUFT LETTER <br /> Page 2 <br /> compacting the tank excavation with clean fill soil . Before receiving a <br /> PHS /EHD corrective action directive and in order to receive the SWRCB Clean up <br /> Fund Letter of Committment , you must make application to the State of <br /> California Water Resources Control Boards ( SWRCB ) " Petroleum Underground <br /> Storage Tank Cleanup Fund " ( Fund ) . An application package for the Fund has <br /> been provided . <br /> The Fund was created pursuant to Chapter 6 . 75 of the California Health and <br /> Safety Code to help eligible owners and operators of petroleum underground <br /> storage tanks to : <br /> 1 . Meet federal requirements to demonstrate financial responsibility , <br /> 2 . Obtain reimbursement for costs of the cleanup of unauthorized <br /> releases of petroleum from USTs ; and <br /> 3a obtain reimbursement for damages awarded to third parties who are <br /> injured by petroleum releases . <br /> The maximum amount available from the Fund is $990 , 000 per occurrence . <br /> Claimants are responsible for the first $ 10 , 000 of eligible costs . <br /> Applications must be submitted to the SWRCB Clean Up Fund by March 31 , 1994 to <br /> undergo eligibility ranking for funding in the 1994-95 state fiscal budget <br /> year . All subsurface investigations and remedial actions must be performed <br /> under a workplan approved by PHS /EHD . <br /> The Fund does not cover the costs incurred for the removal , repair , retrofit , <br /> or installation of USTs .
