3 04 <br /> ki <br /> GROUND WATER MONITORING WELL ACCESS AGREEMENT <br /> Subsurface Investigation-New West Petroleum Corporation <br /> 6437 West Banner Avenue, Lodi, California <br /> OY �� <br /> This license agreement is made this*_day of�204,b and between the Bokides <br /> Family Limited Partnership of Flag City Chevron (6421 Capitol Avenue, Lodi CA), hereinafter <br /> referred to as BFLP (care of Mr. Richard Bokides); and between New West Petroleum (care of <br /> Gilbert Moore-president),property owner at 6437 West Banner Avenue, Lodi CA. <br /> Advanced GeoEnvironmental, Inc. (AGE) is acting on behalf of BFLP and is hereby granted <br /> permission to install one ground water monitoring well for the purpose of investigating petroleum- <br /> impacted ground water at 6421 Capitol Avenue in Lodi, California. The investigation is being <br /> performed under a directive by the California Regional Water Quality Control Board (RWQCB); <br /> AGE will be allowed to gain access to the above referenced well for collection of ground water <br /> samples on a quarterly basis(for approximately 2 years), and will continue to do so until no further <br /> ground water investigation is required by the RWQCB. <br /> The scope of work includes advancing one,eight-inch diameter soil bore-hole through ground water <br /> utilizing a truck-mounted drill rig and attached hollow stem augers.Upon completion of drilling, a <br /> two-inch diameter,perforated well casing will be placed through the center of the bore-hole,and well <br /> construction materials(i.e. sand,bentonite and grout) added to fill the void space between the well <br /> casing and the bore-hole. A traffic rated, bolt-secured, flush mounted, eight-inch steel monitoring <br /> well box will be utilized to cover the well casing. Drilling activities will be completed in one (1) <br /> working day, approximately 4-hours. New West Petroleum will be notified at least one week prior <br /> to performance of any field operations. <br /> All costs for performance of the subsurface investigation will be the sole responsibility of the BFLP; <br /> the BFLP will assume all responsibility, liability, costs and expenses for investigation of impacted <br /> ground water associated with the above referenced ground water monitoring well.Upon completion <br /> of well installation and all field work activities, the well installation area will be returned to its <br /> original conditions prior to field work activities. Upon request, New West Petroleum will be <br /> provided with copies of all testing and reporting for all investigation performed on theirproperty and <br /> will be provided with a copy of the "No Further Action" letter from the appropriate regulatory <br /> agencies upon completion of the investigation. <br /> The undersigned represent and warrant they are duly authorized to execute the agreement and to bind <br /> the parties. <br /> Bokides Family Limited Partnership mew West Petroleum <br /> care of Mr. Richard Bokides Mr. Gilbert Moore,president <br /> P.O.
