Capitol Ave. <br /> Lodi, CA 95242 <br /> On September 28, 2009, the San Joaquin County Environmental Health Department (EHD) <br /> participated in a telephone conference with your consultant, Mr. Robert Marty and Mr. Timothy <br /> Cuellar of Advanced GeoEnviron mental Inc., and your attorney, Mr. Scott Rishwain to discuss <br /> the destruction of five monitoring wells that still have not been properly destroyed. The Central <br /> Valley Regional Water Quality Control Board (CVRWQCB) required destruction of the <br /> monitoring wells installed to investigate the above subject site prior to their issuing a "No Further <br /> Action Required" letter for the above subject site. <br /> In May 2008 the EHD issued permits for destruction of the monitoring wells. The five wells <br /> (MW-8, 9, 10, 11, and 13) were constructed with continuous multichannel tubing (CMT) casing. <br /> Destruction of these wells is problematic because of the small chamber design. Different <br /> methods of destruction have been attempted and an acceptable, reliable method has not been <br /> found. Since encountering a problem with the destruction of MW-13, there has been no <br /> progress in properly destroying these last five wells. By San Joaquin County Well Standards <br /> definition these wells are abandoned and according to Section 6.1 of the Well Standards they <br /> must be destroyed. <br /> It was agreed during the telephone conference that a schedule would be submitted to the EHD <br /> within 30 days. The schedule will include the date the remaining five wells will be properly <br /> destroyed and a plan describing the method and materials to be used to complete the <br /> destruction. It was also discussed that if the destructions are not completed within 45 days of <br /> the date of this correspondence, a referral for formal enforcement action by the San Joaquin <br /> County District Attorneys' Office may be made. <br /> The EHD well destruction permits issued in May 2008 for this work have expired and new Well <br /> Permit Application Forms and $60 permit fee per application must be submitted. The remaining <br /> wells are located on four different parcels so four applications and four $60 fees are required. <br /> Please include private property access agreements and a copy of the San Joaquin County <br /> Public Works encroachment permit with the applications. <br />
