Issued on Behalf of the <br /> California Integrated Waste Management Board <br /> NOTICE OF VIOLATION <br /> This Notice of Violation (NOV) constitutes formal and legal notice that <br /> one or more violations of the Public Resources Code (PRC) and/or Title <br /> 14, California Code of Regulations (14 CCR), occurred and was <br /> documented in the attached Waste Tire Survey & Inspection Report <br /> (Inspection Report). Please refer to the Inspection Report to find the <br /> specific violation(s) cited. Copies of the California Used and Waste Tire <br /> Hauling and Storage laws and regulations are attached and can be <br /> referenced for an expanded explanation of the violation(s) cited. <br /> The NOV is the first step in the waste tire enforcement process. <br /> When violations are discovered, the inspector issues the NOV and <br /> assigns a Compliance Deadline Date (CDD). (See the Enforcement <br /> Status box on page one of the Inspection Report.) The CDD is <br /> the responsible party's deadline to correct the violation(s). <br /> A re-inspection will be conducted within 30 days of the CDD. If that <br /> inspection reveals continued noncompliance, further enforcement <br /> actions may be taken. Further enforcement actions may include, but <br /> are not limited to: (1) issuing Enforcement Orders, (2) filing <br /> Administrative Complaints seeking Administrative Penalties up to <br /> $25,000 for each violation [PRC §42962(a)], (3) filing Criminal <br /> Complaints and seeking penalties, and/or (4) seeking revocation of <br /> Tire Hauler Registrations and/or Waste Tire Facility Permits. <br /> As a business operator, owner, and/or property owner (for tire storage <br /> facilities), you are responsible for complying with the Used and Waste <br /> Tire Hauling and Manifesting Requirements as well as the Waste Tire <br /> Storage and Disposal Standards. As a recipient of this notice, you are <br /> responsible for correcting the violation(s) by the CDD noted on the <br /> Inspection Report. <br /> For your convenience, further information regarding the Waste Tire <br /> Enforcement Process as well as used and Waste Tire Hauler and <br /> Manifest Information has been included on the back of this notice. <br />
