(See CDRRR Stipulation, Decision,and Order,EXHIBIT 1 and Attachments).CDRRR has a streamlined penalty process to save itself and your company time and money if your company and CDRRR can agree on a settlement quickly. In order to do so,you must sign the attached order agreeing to the violations and send CDRRR. the order and a check within 15 days after this letter is delivered to you. If you do not ask for the streamlined penalty process before the 15 day deadline,then CDRRR will start the standard penalty process that allows you to request a hearing. The two penalty processes are described below. Standard Standard Penalty • CDRRR staff recommends a standard penalty of$3,500 for the tire hauler and/or tire manifest violations shown in Exhibit 1 and Attachments. • CDRRR will write an Administrative Complaint for$3,500 in penalties against your company as required by law(Administrative Procedures Act at Government Code Section 11500, et. seq). • When you get the Administrative Complaint your company may ask for a hearing with the Office of Administrative Hearings. • The Office of Administrative Hearings will make a decision based on the facts and may order your company to pay the penalty in the Administrative Complaint. OR Streamlined Streamlined Penal�Process • CDRRR staff recommends a streamlined penalty of 5550 for the tire hauler and/or tire manifest violations as shown in Exhibit 1 and Attachments. (For penalties of 5500 or more,payment installments can be arranged,-please contact Keith Cambridge at (916) 341-6422 ifyou are interested) • Your company reviews the attached Stipulation, Decision and Order including Exhibit 1 that shows the violations in yellow highlight. • if your company agrees with the Stipulation, Decision and Order,your company signs the document on page 2.
