R5-2009-0506 FOR ASSESSMENT OF <br /> MANDATORY MINIMUM PENALTIES, SPX COOLING TECHNOLOGIES (FORMER <br /> MARLEY COOLING TOWER FACILITY), SAN JOAQUIN COUNTY <br /> Enclosed is an Administrative Civil Liability Order (Order), issued pursuant to California Water <br /> Code (CWC) section 13385, for violations of Waste Discharge Requirements (WDRs) Order <br /> R5-2003-0030 by SPX Cooling Technologies (hereafter referred to as "Discharger") at 150 <br /> North Sinclair Avenue in the East Stockton Area of San Joaquin County. The Order assesses <br /> civil liability in the amount of eighteen thousand dollars ($18,000), for Mandatory Minimum <br /> Penalties for effluent limitation violations that occurred from 1 January 2000 through <br /> 30 April 2008. <br /> On 17 November 2008, the Assistant Executive Officer issued Administrative Civil Liability <br /> Complaint (Complaint) R5-2008-0614, which contained MMPs that totaled $33,000. In <br /> December 2008, the Central Valley Water Board received comments from ARC Solutions, <br /> demonstrating that five violations tabulated in Complaint R5-2008-0614 were included in error. <br /> Therefore, this Order, which constitutes a settlement of the violations charged in Complaint <br /> R5-2008-0614, eliminates those five penalties from the list that was included as part of the <br /> Complaint R5-2008-0614. A tentative Order was published on 6 March 2009 and a 30-day <br /> period was provided for interested parties to comment on this action.
