Environmental Protection Agency <br /> 215 Fremont Street, T-1 <br /> San Francisco, CA 94105 <br /> Dear Mr. Vaille: <br /> THE MARLEY COOLING TOWER COMPANY, San Joaquin County <br /> The purpose of this letter is to document the Department' s intent <br /> to ensure that site investigation and remediation processes <br /> scheduled to be conducted by the Marley Cooling Tower Company <br /> (MCTC) will be performed in accordance with the Department' s <br /> Remedial Action Order (RAO) issued pursuant to the California <br /> Health and Safety Code (H&SC) Section 23355. 5, and in a manner <br /> consistent with the RCRA Corrective Action Plan (CAP) guidance <br /> manual. <br /> On March 1, 1988 the Department unilaterally issued an RAO to <br /> MCTC covering the work required to complete the investigation and <br /> remediation process for MCTC' s Stockton facility. As requested <br /> by Mr. Jeff Scott of your staff, several requirements specified <br /> in the CAP were incorporated into the RAO. Mr. Scott <br /> additionally requested during discussions with the Department's <br /> Project Manager, Jim Austreng, that the Department send EPA a <br /> letter addressing the the following issues: <br /> o Which unit within the Department will oversee activities <br /> associated with the remediation of the subject site; <br /> o The measures which the Department will take to ensure RCRA <br /> closure requirements are met; <br /> o What efforts the Department will take to ensure all required <br /> RCRA inspections are performed; <br /> o What actions the Department will take to ensure that work is <br /> performed in a manner consistent with the CAP; <br /> o The actions the Department will pursue in the event MCTC <br /> fails to meet the requirements of the RAO or of RCRA. <br />
