Environmental Protection Agency 215 Fremont Street, T-1 San Francisco, CA 94105 Dear Mr. Vaille: THE MARLEY COOLING TOWER COMPANY, San Joaquin County The purpose of this letter is to document the Department' s intent to ensure that site investigation and remediation processes scheduled to be conducted by the Marley Cooling Tower Company (MCTC) will be performed in accordance with the Department' s Remedial Action Order (RAO) issued pursuant to the California Health and Safety Code (H&SC) Section 23355. 5, and in a manner consistent with the RCRA Corrective Action Plan (CAP) guidance manual. On March 1, 1988 the Department unilaterally issued an RAO to MCTC covering the work required to complete the investigation and remediation process for MCTC' s Stockton facility. As requested by Mr. Jeff Scott of your staff, several requirements specified in the CAP were incorporated into the RAO. Mr. Scott additionally requested during discussions with the Department's Project Manager, Jim Austreng, that the Department send EPA a letter addressing the the following issues: o Which unit within the Department will oversee activities associated with the remediation of the subject site; o The measures which the Department will take to ensure RCRA closure requirements are met; o What efforts the Department will take to ensure all required RCRA inspections are performed; o What actions the Department will take to ensure that work is performed in a manner consistent with the CAP; o The actions the Department will pursue in the event MCTC fails to meet the requirements of the RAO or of RCRA.
