'JUL-1?-91 THU 16:57 SIEGSD ENGINEERING FAX N0. 2090-0214 <br /> P. 03 <br /> ARCO Facility # 04493 <br /> RIGHT OF ENTRY <br /> Atlantic Richfield Company, a Delaware corporation ("ARCO"), hereby grants to <br /> the City of Stockton ("City"), its agents, employees, and contractors, permission <br /> to enter ("Right of Entry") upon the real property adjacent to the Stockton <br /> Channel described as an area measuring 35 feet wide and 110 feet long (the <br /> "License Area") situated at the northeast corner of the intersection of the <br /> Stockton Channel and Center Street in Stockton, California, as shown on the site <br /> plan attached hereto as Exhibit A. The License Area is a portion of real property <br /> owned by ARCO commonly known as 205 N. Center Street, Stockton, California. <br /> The City's Right of Entry on the License Area is for the purpose of conducting <br /> studies, tests, soil sampling and surveys in and on the License Area as required <br /> for a seawall project. <br /> It is understood that no permits will be required of ARCO and that there will be <br /> no interference or interruption of business resulting from the City's use and <br /> occupancy of the License Area. It is further understood that the City shall <br /> defend, indemnify and hold ARCO harmless from any liability resulting from the <br /> use and occupancy of the License Area under this Right of Entry. The City shall <br /> return the License Area to its original or better condition immediately after any <br /> entry has been made and such studies, tests, surveys and soil sampling have <br /> been completed. <br /> The City shall make the results of such tests and studies available to ARCO <br /> upon the City's receipt of final reports. ARCO understands and agrees that, if <br /> required, the City shall make the results of such tests and studies available to <br /> government or regulatory agencies upon their request.
