We ask our clients to <br /> participate in identifying the level of service that will provide them with an acceptable level of risk. <br /> Please contact Condor personnel responsible for this report if you would like to discuss this risk issue in <br /> greater detail_ <br /> The scope of this project was presented in our proposal and contracts number 3073 dated July 14, 2000 <br /> and subsequently approved by Kevin Dougherty. The scope of work for this project was limited to a <br /> qualitative evaluation or environmental concerns associated with the potential presence of hazardous <br /> materials in conjunction with current and previous activities on the Site and did not include other services <br /> that are not described in this report. Specifically excluded from the scope of work are (1) the evaluation <br /> of the Site for the presence of radon, and lead-based paint, (2)a survey of the site for wetlands or rare and <br /> endangered species, (3) a survey of the Site for historical or cultural resources, and (4) research into the <br /> title history of the Site. <br /> Condor has completed the ASTM Phase I ESA, as an independent contractor, in accordance with the <br /> ASTM guidelines and with the customary state of the practice and the prevailing standard of care for <br /> completing such assessments in California at this time. Condor shall not be subject to any express or <br /> implied warranties whatsoever. <br /> Land use, site conditions (both on-site and off-site) and other factors will change over time. Site <br /> activities and regulations beyond our control could change at any time after the completion of this report. <br /> Our observations, findings and opinions can be considered valid only as of the date of the site visit. This <br /> . report should not be relied upon after 180 days from the date of issuance (ASTM Standard E-1527-97, <br /> Section 4.6). <br /> The property owner is solely responsible for notifying all governmental agencies and the public at large <br /> of the existence, release, treatment, or disposal of any hazardous materials observed at the project site, <br /> either before or during performance of Condor's services. Condor assumes no responsibility or liability <br /> whatsoever for any claim, loss of property value, damage, or injury which results from pre-existing <br /> hazardous materials being encountered or present on the project site, or from the discovery of such <br /> hazardous materials. <br /> This report and other instruments or service are prepared and made available for the sole use of the <br /> officers and representatives of First Commercial Real Estate and Advisory Services and Kevin <br /> Dougherty. The contents thereof may not be used or relied upon by any other person(s) without the <br /> express written consent and authorization of First Commercial real Estate and Advisory Services and <br /> Kevin Dougherty and Condor. <br /> 8.0 QUALIFICATIONS AND SIGNATURES <br /> Condor has over 15 years of experience in the performance of Phase I ESAs and environmental audits for <br /> financial institutions, attorneys, private companies and public agencies. Experienced environmental <br /> professionals providing a standard of care consistent with industry practice perform assessments and audits. <br /> These individuals employ guidelines developed by the ASTM. <br /> Monique B. Turner performed the Site investigation under the direct supervision of David K. Wood, Condor <br /> Project Manager and California Registered Geologist. David K. Wood works under the direct supervision of <br /> Ron Skaggs, Division Manager for Condor.
