All information gathered during the study by Kleinfelder is considered confidential and will be released only upon written authorization from the client or as required by law. California law requires a person to inform the state if a situation is encountered that can be considered an immediate endangerment to the public's health or welfare and/or to the environment. Therefore, the client shall be contractually bound to make said disclosures in lieu of Kleinfelder, its owners, principals, employees or subcontractors. CLIENT RESPONSIBILITIES AND ASSUMPTIONS This workplan is based on the following assumptions: • The client will provide Kleinfelder with written authorization for the proposed work in the form of signed contracts • Adequate work space andaccess will be provided by the client. • Kleinfelder's cost estimate is based upon encountering groundwater at approximately 26 feet below ground surface. If groundwater is encountered at lesser or greater depths, costs will be adjusted accordingly. • Kleinfelder is not responsible for the site safety of others. • Client meetings and revisions to the report are not included in the budget estimate, but can be provided on a time and materials basis at the client's request. • Two copies of all documents will be delivered to the client. Additional copies can be provided for a fee of$50 per copy. • Soil and/or water generated during the drilling and sampling will be the responsibility of the client. The drill cuttings and water generated will be contained in 55-gallon drums and will be left on site. • This proposal is based on the .presumption that First Service of Northern California personnel will clearly mark utilities and will provide any and all available survey maps or other data to determine the location of tanks, existing structures, underground utilities and services. • The client should be aware that penetrating the site's surface is inherently risky. It is impossible to determine with certainty the precise location of all structures (such as septic system tanks or leach fields) which may be buried in the ground. 42162.E01 /ST04P 141 Page 7 of 9 Copyright 2004,Kleinfelder,Inc.
