Box 4025, Sacramento, CA 95812-4025 <br /> Terry Tamminen www.ciwmb.ca.gov Arnold Schwarzenegger <br /> Secretaryfor Governor <br /> Environmental <br /> Protection <br /> June 8,2004 <br /> TRACY DISPOSAL CO(127842 1) <br /> P.O.Box 274 <br /> Tracy,CA 95378 <br /> JUNE 2004 NOTIFICATION LETTER <br /> RE:NON SUBMISSION OF MANIFEST AND/OR TIRE TRIP LOG FORMS <br /> Dear TRACY DISPOSAL CO: <br /> On July 1,2003,the California Integrated Waste Management Board(CIWMB)implemented the California <br /> Uniform Waste and Used Tire Manifest System.As a registered Waste Tire Hauler,you are required to complete a <br /> waste tire manifest and tire trip log for any waste or used tires that are transported on a public road.A review of our <br /> records indicates that no tire trip logs and/or manifests have been submitted to the Waste Tire Hauler Registration& <br /> Manifest Program by your company between July 1,2003 and May 15, 2004 At this time,we are not taking any <br /> enforcement action;however,we wish to advise you that if you,as a waste tire hauler,are hauling waste or used <br /> tires and fail to complete and submit the required documentation,enforcement actions may be taken. <br /> Transporting waste or used tires without a properly completed manifest or tire trip log form is a violation of Title 14, <br /> California Code of Regulation, §18460.2(h)as referenced below and is punishable by civil fines of up to$25,000 <br /> per violation[Public Resources Code, §42962(a)]. <br /> 18460.2.Waste Tire Manifest System Requirements for Registered Waste Tire Haulers. <br /> (h)The waste tire hauler shall not transport the used or waste tires without a properly completed Manifest Form and <br /> Tire Trip Log. <br /> In addition,if you are stopped by the California Highway Patrol or local law enforcement and do not have the <br /> required paper work,you may be cited under the California Vehicle Code, §31560(a). <br /> By giving you this notice,we hope to call this deficiency to your attention.If there is a valid reason why we have <br /> not received manifests or trip logs from your company or if you believe that there may be discrepancies in our <br /> record keeping,please call our toll free number at(866)896-0600 for further assistance.If we do not hear from you, <br /> we must conclude that you are hauling waste or used tires in violation of the above law and regulation. <br /> Sincerely, <br /> Keith E.Cambridge,Program Manager <br /> Waste Tire Hauler Registration&Manifest Program <br /> Special Waste Division <br /> California Environmental Protection Agency <br /> 11- Printed on Recycled Paper <br /> The energy challenge facing California is real.
