1 THEREFORE, PURSUANT TO PRC SECTION 42845, YOU ARE ORDERED TO: <br /> 2 1. Cease acceptance of any waste tires at this site until the you either comply with <br /> 3 a. Title 14, California Code of Regulations (CCR), section 18420(a)(7)(e), which <br /> 4 provides that the facility is a tire dealer who stores waste tires at the facility for <br /> 5 less than 90 days if not more than 1,500 waste tires are ever accumulated on <br /> 6 the dealer's premises; or <br /> 7 b. Obtain a Waste Tire Facility Permit and comply with PRC 42834 or 42824; or <br /> 8 c. Store less than 500 waste tires on site. <br /> 9 2. Remove all waste tires that have been stored at the facility for longer than 90 days. <br /> 10 Furthermore, maintain less than 1500 waste tires on site, in accordance with the <br /> 11 following waste tire removal schedule. <br /> 12 a. Waste Tire Removal Schedule <br /> 13 i. The CIWMB must approve the destinations of the tires to ensure that a <br /> 14 registered waste tire hauler legally transports them to an approved <br /> 15 facility. <br /> 16 ii. All waste tires (whole and/or tire equivalents) stored over 90 days shall <br /> 17 be removed by a registered waste tire hauler by January 10, 2006. <br /> 18 Destination receipts and comprehensive trip log manifest forms <br /> 19 CIWMB 203 must accompany each load and copies of manifest forms <br /> 20 must be submitted to the CIWMB on or before January 25, 2007. <br /> 21 Failure to comply with this provision may result in penalties pursuant to <br /> 22 PRC section 42961.5 and 42962. <br /> 23 <br /> 24 <br /> 25 <br /> 26 <br /> 27 <br /> 28 <br /> -3- <br />
