Copies of hazardous waste disposal records for used oil from the forklifts were not found on site. According to the manager, Central Valley Lift Truck services the forklifts and takes the used oil back with them. If the used oil is not being disposed of on a uniform manifest or a consolidated manifest,the following documentation needs to be kept for each facility to show that the repair business is following California Health and Safety Code Section 25250.12 under Article 13 of Management of Used Oil: -The amount of used oil generated showing that no more than 55 gallons is transferred in the vehicle at any one time. -The address information on where used oil is being transported to. -The date the used oil is generated. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately start maintaining all required records. This is a minor violation. 608 CCR 66266.130 Failed to properly manage used oil and fuel filters. The forklifts are serviced by Central Valley Lift Truck. Disposal records for the used oil filters for the last three years were not found on site. Per California Health&Safety Code(HSC)25163, a valid hazardous waste transporter license is required to transport hazardous waste. Per Title 22 California Code of Regulations(CCR)66266.130, oil filters that are not completely drained need to be managed as hazardous waste. If the oil filters are completely drained,they can be disposed of via recycling. A bill of lading needs to be left with the facility for drained oil filters. Per 22 CCR 66266.130(c)(5), a bill of lading needs to indicate: the generator and transporter,the receiving company names, addresses and telephone numbers,the quantity and size of the used oil filter containers transferred, and the date of transfer. If the oil filters are being taken as recycling, immediately start to store the bills of lading when the waste leaves the site. This is a minor violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by March 23, 2019. There must be at least one emergency coordinator on site or on call to coordinate emergency response measures, and the following information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless the facility has a direct alarm.
