� � 1 <br /> 25 <br /> (b) Inspect wastes before accepting them to ensure that the <br /> delivered waste has essentially the same general properties <br /> as identified by the generator on the manifest; <br /> (c) Complete the appropriate section of the manifest. <br /> (d) Sign and date each copy of the manifest to certify that the <br /> hazardous waste covered by the manifest was received; <br /> (e) Note any significant discrepancies in the manifest on each copy <br /> of the manifest; <br /> (f) Immediately give the transporter at least one copy of the <br /> signed manifest; <br /> (g) Send legible copies of all completed hazardous waste manifests <br /> to the California State Department of Health Services on a <br /> monthly basis in conformance with Section 66550, Title 22, <br /> California Administrative Code; <br /> (h) Within 30 days after delivery, send a copy of the manifest <br /> to the generator; and <br /> ( i ) Retain at the facility a copy of each manifest for at least <br /> three years from the date of delivery. <br /> 3. Manifest discrepancies. <br /> Upon discovering a significant discrepancy between the quantity or <br /> type of hazardous waste designated on the manifest and the quantity <br /> or type of hazardous waste a facility actually receives, the owner <br /> or operator shall attempt to reconcile the discrepancy with the waste <br /> generator or transporter (e.g. , with telephone conversations) . <br /> Significant discrepancies in quantity are: (1 ) for bulk waste, <br /> variations greater than 10 percent in weight, and (2) for batch <br /> waste, any variation in piece count, such as a aiscrepancy OT one <br /> drum in a truckload. Significant discrepancies in type are obvious <br /> differences which can be discovered by inspection or waste analysis <br /> such as waste solvent substituted for waste acid, or toxic constit- <br /> uents not reported on the manifest. If the facility can accept the <br /> waste after its actual identity is revealed, the owner or operator <br /> may accept the waste. If the facility cannot accept the waste, <br /> the owner or operator shall immediately notify the California State <br /> Department of Health Services of that fact, identify the transporter <br /> and generator of the waste, and refuse to accept the waste, If <br /> the owner or operator can accept the waste, he shall note, on the <br /> copy of the manifest which he submits to the California State <br /> Department of Health Services and on the copy which he retains , <br /> how the discrepancy was resolved. If the discrepancy is not <br /> resolved within 15 days after receiving the waste, the owner or <br /> operator shall immediately submit to the California State Depart- <br /> ment of Health Services a letter describing the discrepancy and <br /> attempts to reconcile it, and a copy of the manifest at issue. <br />
