Center St. in-Stockton, California(the`.`Property"). As <br /> stated in previous correspondence, The Earthgrains Company ("Earthgrains") has attempted to <br /> work with you on an amicable,voluntary basis to resolve outstanding environmental matters at <br /> the Property, however, you have refused to accept your contractual responsibility thus far. The <br /> attached report has been submitted to Mr.Mike Infurna at San Joaquin County Public Health <br /> Services Environmental Health Division ("PHS/EHD"). Earthgrains has advised Mr. Infurna of <br /> the status of this matter and Earthgrains' efforts to encourage your cooperation in this matter. <br /> 4 g n-54 <br /> - -You will alsote in noEarth rains -transmittal to`1VIr. Ihfurria thatthe environmental work <br /> performed by Philip is the final environmental work that Earthgrains will authorize relating to <br /> this matter and that PHS/EHD should look to you as the "owner"of the Property for any further <br /> action deemed necessary by PHS/EHD or other applicable,regulatory authority. <br /> R <br /> As stated in previous correspondence to you, Earthgrains is not contractually obligated to <br /> perform any of this additional environmental work at the property and has continued to cooperate <br /> with PHS/EHD on a Voluntary basis. I have reviewed the files regarding this rhatter and I <br /> suggest that you review the Release Agreement that you executed in 1994. You should also <br /> consider the fact that you, as the owner of the Property,may be eligible for recovery from the <br /> California Underground Storage Tank Fund.
