In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The site must be brought into compliance to avoid your entire UST system being red tagged - 7 -days from the receipt of this <br />Notice. Outstanding violations include the following: <br />1. A permit to operate the UST system (all tanks) has not been issued. No person may own or operate an UST unless a permit for its <br />operation has been issued by the local agency to the owner or operator of the UST system. (HSC 25284). <br />2. Secondary containment testing failed. Secondary containment testing was performed on September 20, 2017 and the 87 secondary <br />product, 91 secondary product, diesel secondary product, and all UDCs visually failed per technician due to jumper lines in all <br />UDCs. To date, no repairs have been made. Secondary containment testing is required once every 36 months.
