In order to do so,you must sign the attached order agreeing to the violations and send <br /> CalRecycle the order and a check within 15 days after this letter is delivered to you.If you do not ask for <br /> the streamlined penalty process before the 15 day deadline,then CalRecycle will start the standard <br /> penalty process that allows you to request a hearing. The two penalty processes are described below. <br /> Standard Penaltv Process <br /> • CalRecycle staff recommends a standard penalty of$9,800 for the tire hauler and/or tire <br /> manifest violations shown in yellow highlights in Exhibit 1 and Attachment(s). <br /> • CalRecycle will write an Administrative Complaint for$9,800 in penalties against your company <br /> as required by law(Administrative Procedures Act at Government Code Section 11500, et. seq). <br /> • When you get the Administrative Complaint you may ask for a hearing. <br /> • The hearing will be held before CalRecycle's Director or a person delegated by the Director. The <br /> Director,or the Director's delegate,will make a decision based on the facts and may order you to <br /> pay the full penalty requested in the Administrative Complaint. <br /> OR <br /> Streamlined Penalty Process <br /> • CalRecycle staff recommends a streamlined penalty of$4,000 for the tire hauler and/or tire <br /> manifest violations as shown in Exhibit 1 and Attachment(s).(For penalties of$500 or more, <br /> payment installments can be arranged;please contact Keith Cambridge at(916)341-6422 ifyou <br /> are interested). <br /> • You review the attached Stipulation, Decision,and Order, including Exhibit 1 and Attachment(s), <br /> that shows the violations in yellow highlight. <br /> ORkCIKAL PRMTE()ON 100%It)ST[X)MUMER(3)NTENT <br />
