I am waiting <br /> for your response to the proposed revisions to the access agreement. I was surprised <br /> when you rejected the access agreement I had proposed Chevron. Exxon and Unocal have <br /> entered agreements with substantially similar terms with my other clients. Nevertheless, I <br /> remain willing to work with your proposed agreement so long as it is modified to ensure <br /> adequate protections for my clients. <br /> I became aware late last week that Kyle Christie had sent a letter to the San <br /> Joaquin County Public Health Services Environmental Health Division requesting its <br /> assistance in securing access to the property despite the fact that neither my client or I <br /> were courtesy copied in that correspondence. The tactic was unnecessary gamesmanship. <br /> I am not interested in game playing and only desire to assure that my client's interests are <br /> protected. You know that we are in disagreement as to ARCO's status on the property. <br /> We believe that the tenancy has been ongoing, that the terms of the tenancy are <br /> unfulfilled and that ARCO's unilateral opinion as to the completion of the soil <br /> remediation is an inaccurate characterization. <br /> Nevertheless,we remain willing to work with ARCO. Both of our schedules have <br /> contributed to the delay in finalizing this agreement. We did even begin discussing the <br /> access until a week before the December proposed drilling date. Then you were <br /> unavailable to negotiate the terms of the access agreement through the last half of <br /> December until January 4`s- I was not available after that date for the first part of January. <br /> I was unaware that ARCO has rescheduled the work in January until 2 business days <br /> before the work was planned,and then was only informed by voice mail.
