PHS/EHD has previously directed you to perform a detailed, expedited site <br /> assessment using depth discrete and continuous core sampling to define and quantify the full three- <br /> dimensional extent of contaminants in soil and groundwater. <br /> To date ARCO has expressed a willingness to proceed with the investigation at their cost. A workplan was <br /> submitted by the ITGroup on behalf of ARCO to complete this task and was subsequently approved by <br /> PHS/EHD on November 3, 1999. Since that date scheduled fieldwork has been postponed and cancelled <br /> on several occasions due to property access problems. The Rodgers Trust apparently controls access to the <br /> property at this time. PHS/EHD has discussed the issue of access to the property to perform the required <br /> site characterization with all listed responsible parties by telephone. PHS/EHD is aware of contractual <br /> (lease) obligations and disputes between the responsible parties related to the property, its use, and status. <br /> Contractual matters are to be resolved by ARCO and the Rodgers Trust in the appropriate forum(not at the <br /> offices of PHS/EHD). PHS/EHD's authority is limited to issues directly related to Corrective Action <br /> Regulation,Health, Safety and the Environment. <br /> PHS/EHD recommends that the responsible parties reach an agreement forthwith to maintain access for <br /> ARCO to complete the investigation as directed. PHS/EHD now directs the responsible parties to <br /> implement the approved workplan at the site no later than March 1, 2000.
