Charter Way, Stockton, California <br /> Dear Mr. Rowe: <br /> This letter is written to inform you of an additional change in schedule for the <br /> fieldwork to be performed at the subject site. This work was proposed by ARCO <br /> Products Company ("ARCO") in a work plan submitted to and approved by your <br /> office (Pinnacle Environmental Solutions, September 29, 1999). The work plan <br /> was submitted to your office in response to your July 23, 1999 letter addressed to <br /> ARCO and the Rose V Rodgers Trust ("Trust"). Both ARCO and the Trust are <br /> listed as Responsible Parties for the subject property. <br /> The change in the schedule for the fieldwork is due to the fact that ARCO has <br /> been unsuccessful in obtaining access to the property to perform the assessment <br /> proposed in the work plan. One of the current property owners, Lorraine <br /> Halvorson, who represents the Trust for this parcel, has not allowed ARCO <br /> access to the property. ARCO believes that it already has access rights to <br /> perform further assessment activities on the parcel under existing written <br /> agreements with Ms. Halvorson and her co-Trustee, Donald Rogers. However, <br /> Ms. Halvorson appears to disagree with ARCO's position, and is requiring that a <br /> new access agreement be created. Although ARCO's attorney has been working <br /> with Ms. Halvorson's attorney for the past three months to develop this new <br /> agreement, Ms. Halvorson's attorney has been slow to respond. Consequently, <br /> the fieldwork originally scheduled to commence on December 22, 1999, then <br /> postponed until January 18, 2000, is now postponed indefinitely by ARCO. <br /> ARCO was recently contacted by Ms. Halvorson's attorney to continue <br /> negotiations on the access agreement. However, given the length of time it is <br /> taking to finalize the agreement, ARCO believes the most expeditious approach <br /> may be for the San Joaquin County Public Health Services, Environmental Health <br /> Division ("EHD") to obtain access for ARCO.
