accordance with these provisions , and are not coupled with an <br /> interest . At the termination of this Agreement Darpetro shall , <br /> upon request of Pep Boys , provide a quitclaim deed or other <br /> suitable instrument executed and in a form acceptable for <br /> recording which releases all claims of Darpetro in connection <br /> with a real property interest . <br /> 2 . The Allowable Investigation shall be limited to the <br /> activities described in Recital C above , and shall be conducted <br /> at Darpetro ' s sole cost and expense , without any contribution <br /> whatsoever by Pep Boys . Darpetro shall drill and install the <br /> Well , and locate the Borings , only at the precise locations shown <br /> on Exhibit " A " . Darpetro shall not submit any soil removed from <br /> the excavation ( s ) or collected from the Premises to any <br /> scientific or engineering testing without the prior written <br /> approval of Pep Boys . Pep Boys hereby authorizes Darpetro or its <br /> representatives to release any and all analytical data obtained <br /> within the scope of the Allowable Investigation to the Agency ; <br /> provided , however , Darpetro shall provide true and correct copies <br /> of all such information to Pep Boys promptly upon submittal to <br /> the Agency . Darpetro shall provide written notice to Pep Boys at <br /> least forty eight ( 48 ) hours by overnight delivery or facsimile <br /> transmission , in advance of any entry under this Agreement , and <br /> shall provide an opportunity for Pep Boys to obtain split - samples <br /> of all materials collected . Darpetro shall provide Pep Boys <br /> copies of all notices , reports , or other communication concerning <br /> the Premises , the Well , the Borings and the Pollutants sent to or <br /> received from the Agency . Notices given pursuant to this <br /> paragraph shall be addressed as follows : <br /> The Pep Boys <br /> 3111 W . Allegheny Avenue <br /> Philadelphia , Pennsylvania 19132 <br /> Attn : Mr . Darpetro shall promptly commence and diligently pursue the <br /> Allowable Investigation to completion , and shall comply with all <br /> federal and state laws which are applicable . Completion shall be <br /> deemed to occur when the Allowable Investigation is no longer <br /> required by the Agency ; except , however , completion shall not be <br /> deemed to occur if the terms specified by the Agency as a <br /> condition of discontinuing the investigation would require <br /> imposition of covenants running with the land or other <br /> governmentally- imposed notification requirements or land use <br /> restrictions affecting the Premises , in which case Darpetro shall <br /> continue the Allowable Investigation at its sole cost until such <br /> provisions have been deleted by the Agency or until approved by <br /> Pep Boys . <br /> 4 .
