( i ) injuries to persons , ( ii ) damage or other injury to property , <br /> and / or ( ii ) the release , transportation , treatment , storage or <br /> disposal of Pollutants to or from the Premises which arise out of <br /> or are in any manner related to the acts , failure to act , or <br /> negligence of Darpetro or any agent of Darpetro . <br /> 9 . This Agreement shall terminate at the earlier of the <br /> completion of the Allowable Investigation or two years from the <br /> date first above written ; provided , however , if Darpetro provides <br /> written notice prior to expiration that the Agency requires <br /> additional monitoring of the Well then the termination date shall <br /> be extended to the earlier of the completion of the Allowable <br /> Investigation or four ( 4 ) years from the date first above <br /> written . In the event that Darpetro requests further extensions <br /> of this Agreement and establishes a bona fide need related to <br /> environmental objectives of the Agency , then Pep Boys shall <br /> consider such requests , and approve or deny the same within <br /> thirty days after such request is received in writing . <br /> 10 . Darpetro shall secure and maintain , at its own expense , and <br /> provide certificates of insurance to Pep Boys for , workers <br /> compensation insurance as may be required by law , comprehensive <br /> general liability ( including contractual liability ) insurance for <br /> at least $ 3 , 000 , 0000 combined single limit coverage , and auto , <br /> hired car and non -ownership insurance with limits of at least <br /> $ 3 , 000 , 000 . The insurance shall be obtained by Darpetro from <br /> insurers qualified to do business in the State of California and <br /> having a rating of not less than " A - XII " by the A . M . Best <br /> Company Insurance Guide . Darpetro shall provide an endorsement <br /> to the liability policies naming the parties indemnified pursuant <br /> to this Agreement as additional named insureds , along with an <br /> endorsement to such policies providing that such insurance is <br /> primary and that any other insurance maintained by the additional <br /> insureds is excess and non- contributing . All such certificates <br /> and endorsements shall be provided to Pep Boys prior to any entry <br /> by Darpetro or its agents on the Premises . Darpetro shall <br /> provide renewal certificates for all coverage at least thirty <br /> ( 30 ) days before the applicable expiration dates . <br /> 11 . Darpetro hereby waives , to the fullest extent permitted by <br /> law , any and all statutes of limitation or claim of laches with <br /> respect to any claim or cause of action , past , present or future , <br /> which might be asserted by Pep Boys arising out of or relating <br /> directly or indirectly to the Pollutants or the Allowable <br /> Investigation . This Agreement shall be interpreted and enforced <br /> in accordance with California law . <br /> 12 .
