Jerold Walsh Cox , Castle & Nicholson 19800 MacArthur Blvd . Irvine , CA 92715 RE : Access Agreement for Pep Boys 845 E . Charter Way , Stockton CA . ( Site ID # 39841 ) Dear Mr . Walsh : I have received your letter of August 31 , 1995 along with the Access Agreement . In reviewing the documents I find that they refer to Site 39841 . Our firm is the environmental consultant for Site 1060 , which is to the west of the Pep Boys . Your agreement refers to work to be performed in relation to Site 39841 . On April 11 , 1995 , I wrote Pep Boys for access to their property to complete the definition of the limits of contamination from Site 1060 . This permission was denied in their letter of April 28 , 1995 . Subsequently , the San Joaquin County Environmental Health Department ( PHS/EHD ) informed Pep Boys on May 25 , 1995 that they had been assigned Site Number 39841 . The PHS/EHD letter explains the reasons why Pep Boys was named the responsible party and its determination of the eligibility for funds from the Underground Storage Tank Cleanup Fund Program . The PHS /EHD determined Site 39841 was not eligible for reimbursements from the fund . our client ( Site 1060 ) is eligible for reimbursement from the fund and desires to remain eligible for reimbursement . Your access agreement allows us access to the Pep Boys site , however , it is unclear whether the work will be performed in relationship to Site 39841 or Site 1060 .
