l f <br /> �•/ ACCESS AGREEMENT <br /> !H <br /> This Access Agreement (The "Agreement") is made as of November 9, 1998, by and <br /> t .h <br /> �I <br /> among Frank Morita of Morita Bothers and Frank Kozlik, 601 University, Sacramento, Californian <br /> 95825-6706, the ("Owners")in the following context: <br /> Frank Morita is the owner of certain real property-at 814 East Charter Way, Stockton, <br /> California, commonly referred to as (The "Property"). <br /> 1 . <br /> This Agreement is entered into in order for Frank Morita, through its consultants, <br /> Geological Technics Inc. (GTI), to perform an environmental assessment, as recommended in a <br /> report prepared by Wm. J. Hunter & Associates, entitled Workplan for Soil and Groundwater <br /> Investigation dated August 20, 1998. Also to undertake any other activity considered necessary or <br /> advisable to mitigate any environmental problems identified during the Assessment as resulting from <br /> the operation of the Morita Brothers facility (the "Related Acti 1vities"). <br /> Both the parties agree as follows: <br /> The Owners hereby grant Frank Morita of :Morita Brothers, its contractors and <br /> subcontractors, permission to access the property located at 826 East Charter Way, Stockton, APN <br /> 167-181-02 (see Workplan attached Plate III). Assessment includes completing the work as <br /> recommended in the work plan (Workplan for Soil and Groundwater Investigation) prepared by Wm. <br /> J. Hunter & Associates dated August 20, 1998 as requested by San Joaquin County PHS <br /> Environmental Health Division on July 27, 1998 (see letter attached). The Owners shall be given <br /> two(2) days notice prior to Designated Area being accessed for purposes of performing the work. <br /> After notice has been provided, persons authorized by Frank Morita or GTI <br /> i <br /> ("Authorized Persons") may access Designated Area for purposes of performing the Assessment. At j <br /> any time, without notice to The Owner, Authorized Persons lmay access the Designated Area for <br /> purposes of inspecting, observing, maintaining or monitoring conditions (including, but not limited <br /> to, groundwater monitoring wells) on the Designated Area related to the Assessment or the Related <br /> Activities. <br /> i <br />
