The San Joaquin County Environmental Health Department (EHD) has requested and received
concurrence with a "no further action required" (closure) determination from the Central Valley
Regional Water Quality Control Board. This is to notify you that Section 25297.15 (a) in Chapter
6.7 of the Health and Safety Code includes a requirement that EHD (local agency) not issue a
closure letter, or make a determination that no further action is required with respect to
"hazardous substance" underground storage tank release sites unless all current record owners
of fee title to the site have been notified of the proposed action by the primary or active
responsible party.
Please provide EHD certification in writing that all record fee title owners have been notified of
the request for closure. If you are the sole property owner, provide a statement of that fact to
EHD, to fulfill this requirement (form enclosed).
In addition, prior to a closure/no further action required letter being provided to you, the
monitoring wells installed during the site investigation must be destroyed under EHD permit and
inspection. After reviewing the data on these wells, MWA, MW-6, MW-7, MW-106, MW-107,.
MW-108, MW-109, MW-208 and MW-209 must have the well contents removed, typically
through drilling them out, and grouted. Wells MW-2, MW-4, MW-5, MWA 1, MWA 04, MWA 10,
MWA 11, MW-202 and MW-210 can be pressure grouted with the required below surface cut off
and mushroom cap as stated in the San Joaquin County Well Standards. Any deviations from
the well standards must be justified. Please have your consultant or a C-57 licensed driller,
submit two EHD permit applications and $405 permit and inspection fees per permit (total of
$810). If you have any questions, please contact Nuel Henderson at(209)468-3436.
Sincerely,
Nuel C. Henderson, Jr., PG
