The owner or operator shall prepare a contingency plan designed to <br /> minimize hazards to human health or the environment from fires, explosions, or any unplanned release of <br /> hazardous waste to air, soil, or surface water and immediately implement that plan whenever there is a fire, <br /> explosion, or release of hazardous waste which could threaten human health or the environment. <br /> The contingency plan must include: <br /> 1. Description of actions facility personnel will take in response to fires, explosions, or any sudden or <br /> non-sudden release of hazardous waste to air, soil or surface water at the facility; <br /> 2. Description of arrangements made with local police departments,fire departments, hospitals, contractors and <br /> State and local emergency response teams to coordinate emergency services; <br /> 3. List of names,addresses, and phone numbers(office/home/cell)of all persons qualified to act as emergency <br /> coordinator. Where more than one person is listed,one shall be named as the primary emergency coordinator and <br /> all others in order in which they will assume responsibilities; <br /> 4. List all emergency equipment,which includes location, physical description,and brief outline of its capabilities; <br /> 5. Evacuation routes for facility personnel where there is a possibility of evacuation; <br /> 6. Current telephone number for State Office of Emergency Services. <br /> If the facility has a Spill Prevention, Control and Countermeasures plan, or some other emergency or contingency <br /> plan,the owner or operator need only amend that plan to incorporate hazardous waste management provisions that <br /> are sufficient to comply with the requirements of this chapter. Immediately prepare or amend an existing plan to <br /> fulfill the requirements of this chapter. Submit a copy of the contingency plan to the EHD. <br /> This is a Class II violation. <br /> 114 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> Copies of uniform manifests for the disposal of oily solids and paper filters were not found on site for 2016 and only <br /> one record was found onsite for 2017 and two for 2018. The owner stated that his waste gets picked up every <br /> couple of months for oily solids/paper filters. Hazardous waste generators shall retain copies of all manifests signed <br /> off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and <br /> have them readily available for review. Immediately locate a copy of all missing manifests and receipts for the last <br /> three years, maintain them on site, and submit all missing copies to the EHD. <br /> Manifest number 01973423JJK was found without a signed off copy from the destination facility. Hazardous waste <br /> generators shall retain copies of all manifests signed off by the destination facility on site for three years and have <br /> them readily available for review. If the generator did not receive a copy of the manifest with the handwritten <br /> signature of the owner or operator of the facility to which the generator's waste was submitted within 60 days of the <br /> date the waste was accepted by the initial transporter,the generator shall submit a legible copy of the missing <br /> manifest,with some indication that the generator has not received confirmation of delivery. This information shall <br /> be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifest or prepare and submit the required information to DTSC.
