DEC 14 ' 94 12 : 55 NUIELLINI & GRILLI P , 1 / 3 <br /> RIGHT OF ENTRY AGREEMENT <br /> Gary Milano and June Milano , Donald Milano and Barbara <br /> Milano , and Big W Sales , as Permittors , hereby grant <br /> permission to Nomellini Construction Co . , as Permittee , to <br /> install and from time to time sample one ( 1 ) two ( 2 ) inch <br /> diameter monitoring well on the Milano property at the <br /> southeast corner of Argonaut Street and Charter Way in the <br /> City of Stockton , State of California . <br /> The monitoring well will be located near the northerly <br /> edge of the pavement in the parking area in front of Big W <br /> Sales . <br /> The well will be covered with a flush mounted sealed <br /> cover about twelve ( 12 ) inches in diameter which can sustain <br /> vehicle traffic . <br /> For the period and in the frequency required by the <br /> regulators , the well will be sampled . Test results will be <br /> provided by Permittee to Permittors , <br /> Except during the initial installation , final abandon - <br /> ment and any relocation requested by Permittors , the entry <br /> will be limited to taking samples . <br /> Permittee agrees to leave the site neat and clean and <br /> to remove all soil and water produced from its operations . <br /> Permittee agrees to pay the entire cost of the borings <br /> and monitoring wells , testing and abandonment of the borings <br /> and wells including restoration of the monitoring well site . <br /> Permittee will provide to Permittors copies of all test <br /> results . <br /> Permittee agrees to hold Permittors free and harmless <br /> from all costs , claims and expense including reasonable <br /> attorney ' s fees arising out of Permittee ' s entry as permit - <br /> ted hereby . <br /> Permittee will see that its consultants and contractors <br /> will coordinate with Permittors as to the specific location <br /> of any borings and wells . <br /> This right of entry will extend for a period of five <br /> ( 5 ) years from the date hereof provided that Permittors may <br /> terminate this right of entry at any time upon six months <br />
