Independent Trucking, <br /> Inc. (ITL) caused waste oil contamination in the soils below the site due to its admitted practice of <br /> waste oil disposal into a septic tank. However, total petroleum hydrocarbons (TPH) in the form of <br /> diesel and gasoline, aromatic hydrocarbons, and volatile organic compounds (VOCs) also have been <br /> found in the subsurface soils, and a source for these constituents has not been determined. ITI <br /> believes that a significant percentage of the contamination found was caused by activities which <br /> occurred prior to its presence on the property which began in 1985. <br /> Because the full extent of the contamination remains undefined and stockpiled soils need to be <br /> remediated or disposed of, we sent a 15 April 1994 letter to ITT requesting a site assessment work <br /> plan by 6 May 1994. We subsequently assigned Mr. William Miles and Ms. Patricia Nolet <br /> (property owners) as co-responsible parties along with TTI, and required them to submit the work <br /> plan by 24 June 1994. A 13 May 1994 letter from Mr. Larry Bradfish (TTI's lawyer) states, "The <br /> current site owners...have done nothing to investigate and clean up the site...in any respect <br /> whatsoever". This contradicts what has been told to us by Mr. Robert Tautze, representative of Mr. <br /> Miles and Ms. Nolet, who says that the property owners have been sharing 50 percent of the costs <br /> with ITL for all the investigation and cleanup that ITL has undertaken to date. Mr. Lautze stated that <br /> zine properly owners wul soon be contacang iii regarding this nater. <br /> Based on the above information, we find that Independent Trucking, Mr. William Miles, and Ms. <br /> Patricia Nolet all share responsibility for remediating the site pursuant to Water Code Section <br /> 13304. We hereby extend the deadline for submittal of the work plan until 1 August 1994. We <br /> urge all of the responsible parties involved to come to an agreement to allow the site investigation <br /> and remediation to proceed. <br />
