Charter Way RO#: 297 <br /> Stockton, CA CUF#: 12607 <br /> In correspondence dated October 17, 2007, the San Joaquin County Environmental <br /> Health Department (EHD) commented on Site Conceptual Model(SCM) dated February <br /> 13, 2007, submitted to Geotracker and approved Work Plan — Soil Boring Investigation <br /> (Work Plan) dated October 1, 2007. The EHD approved the Work Plan with the <br /> condition that the Geoprobe borings be completed by November 30, 2007 and the <br /> report of findings be submitted to Geotracker by January 18, 2008. <br /> As of the date of this letter the Geoprobe boring investigation has not been performed. <br /> By failing to meet the Work Plan approval conditions you are not in compliance with the <br /> EHD directives. <br /> You are hereby directed to install the two borings before February 29, 2008 and <br /> submit the report of findings, in the format of an updated SCM, to Geotracker for <br /> review by the EHD on April 7, 2008. <br /> The updated SCM is to include a re-estimated mass volume calculation as noted in the <br /> EHD's October 17, 2007 correspondence. <br /> Responsible parties are required to be in compliance with directives issued by the EHD. <br /> The State Water Resources Control Board (SWRCB) Clean Up Fund will be informed if <br /> you continue to remain out of compliance and you may become ineligible to receive <br /> reimbursement for all required investigation and remedial actions. <br /> Additionally, responsible parties may be referred to the Central Valley Regional Water <br /> Quality Control Board (CVRWQCB) for formal enforcement. <br />
