Board correspondence dated 16 April 1999 cited the requirements <br /> necessary for Independent Tn cking to receive a no further action required status for this site. <br /> Recently,we received notificE tion from Mr. Mike Infuma of the San Joaquin County Department of <br /> Environmental Health(SJCD H), that monitoring wells MW-4, 6 and 7 have been properly <br /> destroyed. We have also rece ved a copy of the 2 August 1999 agreement between Independent <br /> Trucking and JM Equipment. This agreement states that JM Equipment at 1245 West Charter Way <br /> accepts responsibility for mor'toning wells MW-1, 2, 3 and 8 at 1145 West Charter Way and MW-9 <br /> on its own property. Nomell' ii Construction Company at 1045 West Charter Way continues to be <br /> responsible for monitoring w(11 MW-5 also at 1145 West Charter Way. Based on the above <br /> information,no further action s required at this site. <br /> Nothing in this determination hall constitute or be construed as a satisfaction or release from liability for <br /> any conditions or claims arisir g as a result of past, current,or future operations at this location.
