Previous submitted <br /> versions of the SPCC plan do not address secondary containment of the tank in question. Secondary means of containment <br /> for the entire capacity of the largest single compartment or container and sufficient freeboard to contain precipitation has not <br /> been provided. <br /> The regulation states: <br /> Position or locate mobile or portable oil storage containers to prevent a discharge as described in §112.1(b).Except for <br /> mobile refuelers and other non-transportation-related tank trucks, you must furnish a secondary means of containment,such <br /> as a dike or catchment basin, sufficient to contain the capacity of the largest single compartment or container with sufficient <br /> freeboard to contain precipitation. <br /> Immediately provide sufficient secondary containment for this and all other portable containers at this facility or as allowed by <br /> CFR 112.7.This is considered a technical amendment,lithe plan will be amended,it must be certified by a professional <br /> engineer as required under CFR 112. <br /> This is a Class II violation. <br /> OVERALL NOTES AND COMMENTS <br /> This is an in-office inspection report.This was written after review of the SPCC plan submitted through email on 09/18/2018 <br /> and an addendum received on 09/20/2018 through email.The SPCC plan in question has a registered Professional Engineer <br /> certification from Gary Madsey,registration number 70508, on 07/15/2018. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the <br /> corrective actions that have been or will be taken for each violation,and any supporting paperwork,within 30 days of receiving <br /> this report. <br /> Starting September 1,2018,all in-office CERS help will be provided at EHD hourly rate($152).
