(AGE) on the above
referenced site and has the following comments.
The Report details the results of the subsurface investigation conducted on the
property. On September 9, 2005, three soil borings were advanced onsite; soil
and grab groundwater samples were collected from these borings. Analytical
results from the various samples show the subsurface soil and groundwater have
been impacted with petroleum hydrocarbon constituents including total petroleum
hydrocarbons (TPH) as diesel, TPH as gasoline, benzene, toluene,
ethylbenzene, xylenes and methyl tertiary butyl ether (MtBE). The Report
recommends the installation of groundwater monitoring wells for further
assessment of the groundwater contamination.
SJC/EHD filed a Hazardous Waste Discharge Notification (Prop 65) and sent a
copy to the California Regional Water Quality Control Board, Central Valley
Region (CVRWQCB). You can contact Duncan Austin at the CVRWQCB SLIC
(spills, leaks investigations and cleanup) Unit at (916) 464-4712 for oversight of
your investigation.
The California Health and Safety Code Section 101480 does allow responsible
parties and Environmental Health Departments to voluntarily enter into remedial
action agreements as long as there is written notification to the CVRWQCB and
the California Department of Toxic Substance Control and those agencies
provide no objection. Mr. and Mrs. De Rose are the responsible parties for this
site at this time.
