In addition, Tuff Boy has , -registered for the CUPA training clay n September 28, 2010.
5. Category: SAG'S.
#50 CCR66262.34 (d) stored hazardous waste onsite greater than 180 days.
Response:
All hazardous waste existing at our Almondwood yard was disposed of in February 2010.
Around that same time, Tuff Boy unloaded non-hazardous items and office furniture out of
approximately ten vans purchased in 2009. In one van, hidden from view, were two 55 gallon
drums. One drum was a "Westates Carbon Inc" aqua scrub drum used apparently for treating
underground waste water. The other drum contained paint sludge. Neither drum originated at
5151 E. Almondwood.
Tuff Boy always inspects purchased used van trailers for waste materials that may have been
unintentionally left by a seller. It has been our experience that 98% of purchased vans are
empty. Tuff Boy has never had an incident where the purchase of a van trailer resulted in a
situation whereby hazardous waste was allowed to be off loaded onto our property from a
purchased vehicle. Furthermore, as to past experiences, Tuff Boy has never found anything
other than office furniture or other non-hazardous items stored in trailers purchased for resale
As to the specific incident involving the two questionable drums, we advise the following: When
a group of vans were unloaded, the contents were staged for evaluation; and, it was not until a
few days later that it was discovered that the two questionable drums were off loaded from one
of the van group. At that point, our employees could not accurately determine from which van
the two drums had been stored, nor, could it be determined who was the originator/owner of the
two drums.
Action taken:
All amounts of hazardous waste have been evaluated and disposed of in accordance with San
Joaquin county guidelines.
In the case of the 55 gallon drum filled with paint sludge: Shop Hazards Solutions hauled the
waste material off on July 07, 2010, per manifest#001154590GBF, enclosed with this letter.
In the case of the 55 gallon drum indentified as the "Westates Carbon Inc" aqua scrub barrel:
Please refer to a Argon Laboratories analytical sample report for results from a laboratory test
on the content material enclosed in the "Westates Carbon Inc". aqua scrub barrel.
The Argon Laboratory test results show that none of the items on the report showed positive
test results, thus indicating that the material was non-hazardous. Shop Hazards Solutions
submitted a copy of the Argon Laboratory test report to a waste site and received approval to
dump the waste barrel. Shop Hazards Solutions, then picked up the non-hazardous materials
on July 28, 2010 and disposed of in accordance with county practices.
In closing, I would like to state that Tuff Boy has worked diligently to correct all violations
brought to its attention as a result of the June 30, 2010 inspection.
Please contact me if you need any additional information pertaining to this matter.
Best Regards,
1
Martin Harris
3
