In your letter dated August 7,2006,you requested an exemption for <br /> Tire Derived Products processed from waste tires and/or waste tire equivalents at your facility located at <br /> 13000 Newport Road,Ballico,CA. This material is then sold and transported offsite to another location <br /> as"Tire Derived Product"(TPD)or"Tire Derived Fuel"(TDF). By the description of this material, it <br /> appears that the criteria as set forth in Public Resources Code(PRC), §42950 0),which is described <br /> below,has been met. <br /> 30 PRC §429500) "Tire Derived Product" means material that meets both of the following <br /> requirements: <br /> 1. Is derived from a process using waste tires or waste tire equivalents as a feedstock. A <br /> process using waste tires or waste tire equivalents includes, but is not limited to,shredding, <br /> crumbing,or chipping. <br /> 2. Has been sold and removed from the processing facility. <br /> In your letter you mentioned the following materials: <br /> • Tire Chip Fuel or Tire Derived Fuel(TCF or TDF)-a 2"nominal chip which is shipped in bulk— <br /> usually in walking floor trailers. <br /> • Civil En ing eeringShreds-vary in size but are usually 3-6"chips also shipped in bulk to a project site— <br /> either in end dump or walking floor trailers. <br /> • Other Tire Derived Products(plUground or landscape nuggets,crumb rubber,etc.)–these products <br /> are sold in 40 lbs.bags either individually or palletized 50 to the pallet,or in 2000 lb.super sacks <br /> palletized. <br /> CalRecycle does not regulate this material as a waste tire equivalent pursuant to Title 14,California Code <br /> of Regulations(CCR)§18451(c),therefore,we do not require the transporter of this material to be a <br /> CalRecycle Registered Waste Tire Hauler nor comply with the California Uniform Waste and Used Tire <br /> Manifest System,as long as the following conditions are met: <br /> ORIGINAL PRINTED ON 100%POSTCONSUMER COMENT,PROCESS CHLORINE FREE PAPER <br />
