I <br /> The following is an itemized list of hazardous waste violations that have not been <br /> addressed for XPO Logistics Freight, Inc.-UST as of April 09, 2019. <br /> I <br /> Open violations from December 06, 2017 inspection <br /> Violation#102 - Failed to determine if a waste is a hazardous waste. <br /> The following items need a hazardous waste determination. <br /> Several containers were stored west of the office area with other waste containers and were marked with the <br /> following numbers and contents: <br /> #37, tote of Indulin AA-86, <br /> #11, 50 gallon blue poly drum with Rapicide P.A Disinfectant, <br /> #8, Yellow poly drum, no labels or paperwork <br /> #6, 50 gallon steel drum, Promar 400 Gloss Enamel/Sherwin Williams Paint <br /> #33, 55 gallon steel drum, SEA 30 marine engine oil i <br /> #18, Yellow drum, paint or deck stain <br /> #1, Yellow poly drum, paint <br /> #11, Blue Poly drum, batteries,wet, filled with acid 1 <br /> #12, Yellow poly drum, paint <br /> A one gallon container labeled as paint on top of hazardous waste container identified as#20 <br /> A large grey container with used absorbent was observed at the bottom of the access ramp on the northeastern side <br /> of the building. <br /> Diesel-saturated absorbent was observed at the base of the diesel dispenser. Review of previous disposal records <br /> do not list such material being disposed of as hazardous waste by the facility. <br /> i <br /> Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately make a <br /> hazardous waste determination for each item listed above. Submit supporting documentation for each <br /> determination. Manage each waste according to Title 22 California Code of Regulations. Submit disposal records <br /> for each item. <br /> Violation#110-Failed to keep signed copy of manifests from the designated facility for three years. <br /> A copy of an uniform manifest for the disposal of Nalco Tower Brom 960, UN2465 Dichloroisocyanuric acid, dry or <br /> dichloroisocyanuric acid salts was not found on site. 456 pounds of this waste was generated in 2016 according to <br /> documentation found at the facility. Hazardous waste generators shall retain copies of all manifests signed off by <br /> the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have <br /> them readily available for review. Immediately locate a copy of the disposal manifest for the above waste, maintain <br /> on site, and submit a copy to the EHD. <br /> Disposal manifests were not found for spill waste from several 2017 incidents reported to the SJCEHD: <br /> 1. Spill occurred on April 18, 2017, one 50 gallon drum of absorbent/batteries waste was generated. <br /> 2. Spill occurred on Aug 14, 2017, one drum of four batteries waste was generated. <br /> 3. Spill occurred on Aug 17, 2017, two drums of herbicide, epoxy/sheer-loxane, mineral oil, sodium carbonate <br /> peroxydate waste was generated. <br /> 4. Spill occurred on Sept 14, 2017, one drum of paint/marine enamel waste was generated. <br /> 5. Spill occurred on Sept 19, 2017, one 55-gallon drum of contaminated cardboard waste was generated. <br /> 6. Spill occurred on Oct 2, 2017, one 55-gallon drum of autobody polish and contaminated cardboard waste was <br /> generated. <br /> Immediately locate a copy of the disposal manifest for the above waste, maintain on site, and submit a copy to the I <br /> EHD. <br /> i <br /> Page 1 of 2 <br /> I <br />
