Section 3.7.5 of the SPCC plan <br /> states that records of briefings and discharge prevention training are kept for a period of three years. <br /> -Section 3.9.2 of the SPCC plan states that Table 7(transfer operations)is posted next to the unloading area. Upon <br /> inspection Table 7 was not observed posted next to the unloading area. <br /> The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and <br /> implement a Spill Prevention Control and Countermeasure Plan, in accordance with§ 112.7 and any other <br /> applicable section of this part. The SPCC plan should be implemented as written. <br /> This is a minor violation. <br /> 301 CFR 112.5(a) Failed to amend Plan as necessary. <br /> -Section 3.5.3 of the SPCC plan states that spill kits are located near the AST's loading rack. No loading rack was <br /> observed during the inspection. <br /> -Section 4.1 of the SPCC plan states that there are concrete berms. Concrete berms were not observed during the <br /> inspection. <br /> -Section 4.2.3 of the SPCC plan states that the gate valves are normally kept in a position which allows active <br /> draining of the berm. Gate valves and berms were not observed during the inspection. <br /> -Section 4.2.4 of the SPCC plan discusses underground piping. No underground piping was evident during the <br /> inspection. <br /> The Spill Prevention, Control, and Countermeasure(SPCC) Plan must be amended when there is a change in the <br /> facility design, construction, operation, or maintenance that materially affects its potential for a discharge,within 6 <br /> months of the change, and implemented as soon as possible, not later than 6 months following preparation of the <br /> amendment. Immediately make sure the SPCC Plan accurately represents the procedures and policies currently in <br /> place at the facility. <br /> This is a repeat violation, Class II. <br /> 618 CFR 112.7(e), 112.8(c)(6)Failed to keep records of procedures, inspections, or integrity tests for three years. <br /> The monthly and annual inspection forms being used are not the forms provided by Spill Prevention, Control, and <br /> Countermeasure(SPCC) Plan, and in some instances,do not contain the same information. Weekly and daily <br /> hazardous waste inspection forms are currently being used. Inspections and tests must be conducted and stored in <br /> accordance with the written procedures developed for this facility in the SPCC Plan.
