A hazardous waste generator shall not treat, store, dispose of, <br />transport or offer for transportation, hazardous waste without a hazardous waste ID number. Go to the DTSC web <br />site http://www.dtsc.ca.gov/IDManifest/PERMHWID.cfm for the form to reactivate the ID number. Immediately <br />reactivate your state ID number and submit evidence to the EHD. <br />This is a repeat violation, Class II. <br />102 <br />CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />In the shop area, metal fines are generated and collected without disposing of them. The facility is not sure how to <br />dispose of the waste. Any person who generates a waste shall determine if the waste is a hazardous waste. <br />Immediately make a hazardous waste determination for the waste and manage it according to Title 22 hazardous <br />waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined <br />to be a hazardous waste. Submit a statement and supporting documentation explaining how the metal fines are <br />going to be managed. <br />The following items were observed on the south side of the yard area: <br />-Eight rusted one pint paint cans <br />-One rusted 55 gallon steel drum containing rainwater, absorbent, and other material <br />-Three blue 55 gallon poly drums containing an unknown material <br />-Two blue and four white 30 gallon poly drums containing an unknown material <br />-One white 16 gallon poly drum containing an unknown material <br />-Five 5 gallon plastic buckets containing an unknown material <br />Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately make a <br />hazardous waste determination for the items listed above and manage them according the Title 22 hazardous waste <br />regulations. Submit a statement and supporting documentation explaining how each item was managed. <br />This is a minor violation. <br />104 <br />CCR 66262.34(d)(2) No modified contingency plan. <br />The contingency plan was out of date. The plan listed Ryan Cheers as the emergency coordinator instead of the <br />current one, Steve Showers.
