Spada/ore <br />Airport Manager <br />SUBJ ECT: Warning - Hazardous Waste: Disposal of Used Engine Oil <br />It has been brought to my attention that for the past several weeks <br />nearly every trash receptacle adjacent to the aircraft T -Hangars have <br />been found to contain large amounts (quarts to gallons) of used <br />engine oil. It has become obvious that some aircraft owners are <br />changing their own engine oil and then disposing of this waste oil by <br />pouring it into the trash receptacles that have been provided only for <br />waste paper, rubbish and empty cans. These containers were not <br />intended to be used for the disposal of waste petroleum products. <br />For your information, to dispose of waste oil, or any other hazardous <br />waste, in anything other than an approved container appropriately <br />labeled and utilized for that purpose, is a violation of the State of <br />California Health and Safety Code Section 25189(c) of Division 20, <br />Chapter 6.5, Article 8. Section 25189(c) states, in part: <br />"Any person who intentionally disposes or causes the disposal of <br />any hazardous or extremely hazardous waste at a point which is <br />not authorized according to the provisions of this chapter shall <br />be subject to a civil penalty of not less than one thousand <br />($1,000) or more than twenty-five thousand dollars ($25,000) for <br />each violation.... <br />Further, Chapter 6.5 states that each container must be emptied at <br />least once every ninety (90) days by a State certified waste recycler. <br />Accordingly, the Department of Aviation has been asked by the San <br />Joaquin Local Health District to closely monitor this situation, notify <br />Local Health officials, cite each violator and refer each case to the <br />San Joaquin County District Attorney's office for appropriate action. <br />It is not the desire of Airport Management to issue citations for <br />violations of the State's Hazardous Waste Control Law, but merely to <br />ensure that all applicable rules and regulations pertaining to the <br />State of California Health and Safety Code are adhered to. <br />I wish to thank you for your cooperation in complying with this <br />legislation.
