Quarterly Report - 152 East I lth Street, Tracy Page 3 <br /> S Copv transmitted to the California Regional Water Qualitv Control Board - Central Valley <br /> Region (RWQCB) <br /> Search for Dischargers Responsible for Release of Hydrocarbons <br /> The present owners, Mr and Mrs Albert Navarra and Mr and Mrs Carl Navarra (the <br /> Navarras) purchased the 152 East Street property in December 1978 Since that time no <br /> fuel dispensing or other operations have been conducted on the site that could account for <br /> the contamination that has been found in the subsurface The owners of the site <br /> immediately prior to its purchase by the Navarras were the San Diego Armour Oil <br /> Company and associated parties That company, and other prior owners, operated an <br /> automobile service station on the site and operated the underground storage tanks from <br /> which gasoline leaked into the subsurface <br /> The San Diego Armour Oil Company has been unresponsive to communications by the <br /> State Water Resources Control Board Division of Clean Water Programs and the <br /> SJCPHS that have directed that company to meet its responsibilities under the applicable <br /> regulations to investigate and remediate the contamination found on the property and to <br /> pay regulatory oversight fees <br /> The Navarras' attorneys have filed a compliant against San Diego Armour Oil and <br /> associated entities with respect to this matter in California Superior Court <br /> Petroleum Underground Storage Tank Cleanup Fund <br /> ks the present property owners, the Navarras applied to the California State Water <br /> Resources Control Board, Division of Clean Water Programs (CSWRCB) under the <br /> Petroleum Underground Stoiage Tank Cleanup Fund program for a grant to meet the cost <br /> of investigating and remediating the subject site The CSWRCB designated that <br /> application as Claim No 4928 and, on December 29th , 1994, issued an iriitial Letter of <br /> Commitment for Reimbursement of Costs whach covered a portion of the cost of the site <br /> investigation and characterization work that had been performed at the subject site under <br /> the direction of the RWQCB and the SJCPHS prior to the time the Navarras filed the <br /> application for a grant <br /> In compliance with the terms of the Letter of Commitment issued by the CSWRCB, <br /> during the reporting period the Navarras prepared a Standard Form Payment Request and <br /> compiled the associated accounting and technical documentation that is required for <br /> disbursement of funds under the Petroleum Underground Storage Tank Cleanup Fund <br /> program The Standard Form Payment Request was submitted to CSWRCB on 17th <br /> March 1995 In a letter dated April 14th 1995, the CSWRCB informed the Navarras' that, <br /> the Board's staff had completed an initial item by item review of the Standard Form <br /> Payment Request and supporting documents That review identified cost items for which <br /> immediate grant payment could be authorized and other items for which the eligibility for, <br />
